Lumiardi Platform Terms of Use

1.1. These Terms of Use govern the use of the Lumiardi digital platform, operated by LUMIARDI GESTÃO DE CONTEÚDO LTDA., hereinafter referred to as LUMIARDI.

1.2. By creating an account, completing the required age verification or using any feature of the platform, the user declares that they have read, understood and expressly agree to these Terms.

1.3. The following form an integral part of these Terms for all legal and operational purposes:

• Privacy Policy and LGPD;
• Content and Moderation Policy;
• Age and Identity Verification Policy;
• Model/Creator Adhesion Agreement, where applicable;
• Other policies, guidelines and specific rules published by Lumiardi.

1.4. If the user does not agree with any provision of these Terms, they must immediately stop using the platform.

3.1. Lumiardi is a provider and operator of a digital platform offering technology infrastructure, a professional catalog and business networking.

3.2. Lumiardi does not act, by the mere provision of the platform, as:

3.3. Content is produced and made available under the sole responsibility of the respective users.

3.4. Lumiardi may perform technical functions of hosting, organization, indexing, classification, moderation, security, identity/age verification and provision of contact tools.

3.5. The adoption of moderation or security mechanisms does not make Lumiardi the author, producer or co-producer of the content published.

5.1. The user must provide true, accurate, current and complete information in all forms.

5.2. The following are strictly prohibited:

• Using a false identity or fraudulent pseudonym;
• Using third-party documents (with or without authorization);
• Creating or selling accounts in the name of third parties;
• Sharing access credentials or 2FA keys;
• Circumventing or attempting to circumvent biometric and document verification flows;
• Tampering with digital documents or identification photos;
• Using emulators, malicious proxies or security evasion tools.

5.3. Lumiardi may request new proof of identity or age at any time in the event of registration inconsistencies, suspected fraud or changes to data.

6.1. The user is solely and exclusively responsible for the accuracy of the information provided and for all acts performed through the use of their account and credentials.

6.2. The user must keep their credentials confidential and notify Lumiardi immediately if they suspect loss or unauthorized access.

6.3. The user shall be civilly and criminally liable for any content they produce, publish, transmit or make available, without prejudice to any legal measures Lumiardi may take.

7.1. The user represents and warrants that they hold all authorizations, image rights assignments, copyright ownership or valid legal grounds to make any material available on the platform.

7.2. The publication of material depicting third parties requires formal written authorization and the express consent of all persons involved (18+).

7.3. The publication of content obtained through violence, threats, coercion, fraud, blackmail, invasion of privacy or without free and informed consent is strictly prohibited.

9.1. The user remains the sole owner of the copyright and economic rights legally belonging to them in the content they create or upload.

9.2. By making content available in the Lumiardi environment, the user grants Lumiardi a limited, non-exclusive and temporary license, strictly necessary for the technical operation of the platform.

9.3. The license covers exclusively the following technical operations: hosting, encrypted storage, processing, technical reproduction, transmission, indexing in the authenticated catalog, restricted display within the platform, backup and secure technical distribution.

9.4. This license does not constitute any transfer or permanent assignment of copyright ownership.

9.5. Lumiardi may only use the content for external promotional, advertising or commercial purposes where there is a prior contractual basis or the specific and express consent of the rights holder.

10.1. Lumiardi provides technology tools so that accredited agencies can find models and creators, and so that models can evaluate representation opportunities.

10.2. The platform provides channels and features for communication, negotiation and professional networking.

10.3. Any engagement for the provision of services or advisory work is established directly between the contracting parties.

10.4. Lumiardi does not guarantee: actual engagement, minimum levels of remuneration, volume of offers, audience or specific commercial results.

11.1. The platform offers subscriptions, access plans and corporate features whose prices and conditions are itemized in advance.

11.2. Commercial terms, renewals and billing periods are clearly presented before the purchase is confirmed.

11.3. Payment processing may be handled by approved, internationally certified third-party gateways.

11.4. Transactions showing signs of fraud, improper chargebacks or suspicious activity may be blocked as a precautionary measure.

12.1. Lumiardi uses automated tools and continuous human review to: detect prohibited content, review formal reports, prevent fraud, comply with court orders and safeguard the legal and operational security of the platform.

12.2. In the event of well-founded suspicion or a proven violation, content may immediately be: flagged, restricted, de-indexed from the catalog, temporarily withheld or permanently removed.

Lumiardi may suspend as a precautionary measure, or terminate as of right, the account of any user in the following cases:

• Breach of any clause of these Terms or of the annexed policies;
• Document fraud, false representation or suspicion of being a minor;
• Posting of unlawful or unauthorized content;
• Infringement of third-party copyright, trademarks or privacy;
• Attempted exploitation of vulnerabilities or security evasion;
• Order from a competent police, regulatory or judicial authority;
• Creation of systemic, legal or reputational risk to the user community.

14.1. Lumiardi provides the Reporting, Abuse and Rights Portal as the formal notice-and-action channel for receiving takedown requests, abuse reports and rights protection claims.

14.2. Reports involving a suspected minor or the unauthorized disclosure of intimate content (NCII) receive priority handling and emergency processing.

14.3. Lumiardi will retain the logs and evidence necessary to support any police investigations and compliance with court orders.

15.1. The trademark LUMIARDI, logos, layout, source code, software architecture, databases, interfaces, algorithms and technical documentation are the exclusive property of LUMIARDI GESTÃO DE CONTEÚDO LTDA.

15.2. Any reverse engineering, copying, automated scraping or unauthorized commercial exploitation of Lumiardi's intellectual assets is expressly prohibited.

16.1. Lumiardi employs strict technical protection standards, including: encryption in transit and at rest, least-privilege access control (RBAC), multi-factor authentication (2FA), continuous monitoring and protection against unauthorized access.

17.1. To the extent permitted by applicable law, Lumiardi is not liable for unlawful acts committed exclusively by third parties outside its direct sphere of technical control.

17.2. This clause does not exclude any mandatory legal liability imposed by the Marco Civil da Internet (Brazilian Internet Civil Rights Framework, Law No. 12,965/2014) or by the LGPD.

18.1. All personal data processing operations within the platform are strictly governed by the Lumiardi Privacy Policy and LGPD, in full compliance with the Brazilian General Data Protection Law (Law No. 13,709/2018).

19.1. Lumiardi may periodically review and update these Terms to reflect legal, regulatory, technological or security developments. Material changes will be communicated transparently to users.

20.1. These Terms of Use are governed by and construed in accordance with the laws of the Federative Republic of Brazil.

20.2. The competent jurisdiction will be determined in accordance with applicable law, subject to the rules on territorial jurisdiction and consumer protection, where applicable.
